Noida: Beginning Friday,all unauthorized properties found flouting land-use bylaws will be sealed in Noida.The drive, following a Supreme Court order, is set to hit scores of shops,nursing homes, gyms and restaurants being run from buildings where commercial activity is prohibited.
According to a preliminary survey by the Noida Authority earlier last month,around 25% of industrial and residential areas housed unauthorized commercial units.
Banks may get some relief as the Noida Authority notified a scheme on Thursday to facilitate shifting of banks operating from residential plots to commercial ones.
Illegal Noida shops to face closure
Noida: After receiving the Supreme Court order on Wednesday,the Noida Authority issued a warning to all property owners,whose premises in residential areas have been leased to commercial units.Several teams will scour the city for unauthorized units across allcategories residential,industrial and institutional.Chief executiveofficer of Noida,captain S K Dwivedi,confirmed that sealing would begin from Friday.
The sealing action will cover all nursing homes and shops being run in any residential or non-conforming areasof thecity, additional CEO Anil Raj Kumar said.The entire land falling under Noida is leasehold land,leasedout for a particular purpose clearly defined in the lease deed.Any use of the property not allowed by the lease deed renders the lessee liable to penalties as well as sealing of the premises,including a cancellation of the lease deed.
More than 250 notices have already been issued to plot owners running unauthorized activities in their premises, said an official.In the first phase of the sealing drive,the Authority plans to target establishments operating illegally in residential areas and thereafter industrial and institutional areas.
The SupremeCourthad,on December 5,2011ordered a stop to all commercial activity in residential areas.It said that banking or nursing homesor any other commercial activity is not permitted in Sector 19 and for that matter,in any sector,in the Development Area earmarkedfor residentialuse.
Subsequently,some representatives of the affected establishments approached the apex court for relief and the present order is consequent to the presentation made before the Supreme Court by the CEO Noida. Source>>>
